Conditions of Participation for the Toshiba Prize Draw
The following terms apply exclusively to participation in the Toshiba prize draw, organized by Toshiba Electronics Europe GmbH, referred to below as "Toshiba", as part of Cloudfest 2024 from 18.03. to 20.03.2024, booth C04 in Rust Germany.

1. Participation in the prize draw is free and there is no requirement to purchase goods and/or services from Toshiba.
2. Legal representatives and employees of Toshiba and its legally associated companies and their families are not permitted to participate in the prize draw.
3. Only natural persons aged 18 years or more are entitled to participate. By inserting a draw ticket into the raffle drum , you specifically agree to these conditions of participation. Every participant can only participate once.
4. Raffle tickets for the raffle will be handed out by Toshiba staff at the Toshiba booth C04 at the opening times of the CloudFest and after the speeches of Rainer W. Kaese at the following times and places:
Tuesday, March 19th, 2024, 11:30 to 12:00 am at the Dome Stage
Tuesday, March 19th, 2024, 3:05 to 3:35 pm at the Berlin Ballsaal
5. Each raffle ticket has a number and the date of the raffle written on it. The number is only valid on the date noted on the raffle ticket. The raffle ticket consists of two parts with a perforation line, which can be divided. Both parts show the number and date.
With the raffle ticket, the participant needs to come to the Toshiba booth C04 at the time of the raffle, indicated on the raffle ticket:
• Tuesday, March 19th, 2024, 5 pm
or
• Wednesday, March 20th, 2024, 4 pm
The participant can keep one part of the raffle ticket, while the other part of the ticket will be put into the raffle box on booth C04 by Toshiba staff.
6. For the raffle, Toshiba has set up a NAS system with 60 Toshiba drives. The Toshiba staff now pulls out one ticket part out of the box. The person, who has the raffle ticket with the same number, can pull a hard drive out of the system. This process is continued, until one participant takes out a hard drive and the system crashes. If that happens, this participant will win a QNAP 2-bay NAS equipped with two Toshiba N300 4TB. The price will be handed out to the winner at the booth.
7. Toshiba retains the right to award prizes of similar value if the stated prize is no longer available, no matter for what reason. A pay-out in cash or as a credit note is not possible. The prize is non-refundable and cannot be exchanged for a different one.
8. Toshiba retains the right to terminate the prize draw early, or extend it, at any time, without prior notification or stating the reasons. This applies especially if the prize draw cannot be conducted properly for technical or legal reasons. In such a case, participants have no claims of any kind against Toshiba.
9. Toshiba retains the right to exclude participants from the prize draw for good reason and to ask for prizes to be returned, especially if there is reasonable suspicion or proof of false declarations, manipulation, contravention of these conditions of participation, or other unauthorised behaviour.
10. The draw of a raffle ticket itself is decisive. Win claims cannot be transferred.
11. The judges' decision is final. All decisions made by Toshiba are final.
12. The participant is personally responsible for paying taxes on the prize.
13. If individual provisions in these conditions of participation are, or become ineffective, this will in no way affect the legal validity of the other provisions. Any ineffective individual provision will be replaced by an effective regulation that meets the purpose of the ineffective regulation in the best way possible.
14. The prize draw is exclusively subject to the laws of Germany.
